Notice of Ownership

This website is produced and owned by a Private Party under agreement with the Signal Corps OCS Association, Inc. (a.k.a. and referred to within this document as the U.S. Army Signal Corps OCS Association, all hereinafter, the "Association").

While the thematic purpose of this Website is set by the Association, the Private Party is solely responsible for all Website matters relating to the website, including legal, content, copyright and otherwise. Accordingly, for all Website issues or inquiries please contact:Webmaster@ArmySignalOCS.com. The URL of this website is http://www.ArmySignalOCS.com.

The Association is organized pursuant to the provisions of the Georgia Nonprofit Code O.C.G.A. 14-3-202. The registered address of the Association is: Signal Corps OCS Association, Inc., 1427 Hwy 138 S.W., Conyers, Georgia 30208-2553.

The views and opinions expressed on this website are offered in order to stimulate interest in those who visit it. They are solely the views and expressions of the authors and/or contributors to this website and do not necessarily represent the views of the Army Signal Corps Officer Candidate School Association, its Officers, Directors, members, volunteers, staff, or any other party associated with the Association.

If you believe that this Website contains copyrighted material that has been infringed upon or used without appropriate approval, please immediately contact the Webmaster at  Webmaster@ArmySignalOCS.com and indicate 1) the specific page URL, 2) location of the item on the page, 3) a description of the item, 4) details concerning who you believe the copyright holder is, 5) how to reach such claimed copyright holder, 6) proof of claims to the copyright, and 7) what steps the claimed copyright holder wishes be taken. We will immediately contact the copyright holder directly.

 II. Terms of Use

The content of this Website is subject to change without notice. While most content is publicly accessible, certain services and information offered may be restricted to specific users or segments of the Association and/or its clients and customers.

The terms and conditions of this Agreement shall govern the relationship between you and the Association with respect to this Website. By using this Website you agree to be bound by the following terms and conditions of use.

    A. Acceptable Use Policy

The Association regularly monitors and updates the content on this Website.

If the Association receives a notification of an alleged violation of law or policy regarding such content or the use of this Website, we will investigate and address any violations accordingly. If you feel we have violated a known legislative act or know of a misuse of this Website, contact us by email at Webmaster@ArmySignalOCS.com. Following our investigation we will make a determination and, in our sole discretion, may remove, block, filter or restrict by any other means any materials that may be illegal, may subject us to liability or may violate these Terms of Use. In addition, the Association will cooperate with legal authorities and/or third parties in the investigation of any suspected or alleged crime or civil wrong relating to or stemming from this Site or the use of this Site. Violation of these Terms of Use may result in the suspension or termination of access to this Site, other actions as detailed below or prosecution under applicable law.

You may not use the Association Website for any of the following purposes:

(1) To transmit any material (by uploading, posting, email or otherwise) that is unlawful, threatening, abusive, harassing, tortuous, defamatory, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically or otherwise objectionable;

(2) To impersonate any person or entity or falsely state or otherwise misrepresent your affiliation with a person or entity; forge headers or otherwise manipulate identifiers in order to disguise the origin of any material transmitted through this Site;

(3) To transmit any material (by uploading, posting, email or otherwise) that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);

(4) To transmit any material (by uploading, posting, email or otherwise) that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party including without limitation, music, lyrics, audio, or audiovisual materials, photos or other images that are the copyrighted property of a third party;

(5) To transmit (by uploading, posting, email or otherwise) any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of unauthorized solicitation;

(6) To transmit any material (by uploading, posting, email or otherwise) that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software, hardware, internet or communications equipment;

(7) To disrupt the normal flow of dialogue, cause a screen to “scroll” faster than other users of the Site and/or the services of this Site are able to type or otherwise act in a manner that negatively affects any other user’s ability to engage in real-time exchanges;

(8) To interfere with or disrupt the Sites or servers or networks connected to the Sites or disobey any requirements, procedures, policies or regulations of networks connected to the Sites;

(9) To intentionally or unintentionally violate any applicable local, state, national or international law, including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange, including, without limitation, the New York Stock Exchange, the American Stock Exchange, OTC exchanges or the NASDAQ, and any regulations having the force of law;

(10) To “stalk” or otherwise harass another; or collect or store or attempt to collect or store personal data about third parties without their knowledge or consent.

The Association requests that anyone who believes that there is a violation of these Terms of Use direct the information to the Information Technology department at Webmaster@ArmySignalOCS.com. If available, please provide the following information: (1) the IP address used to commit the alleged violation; (2) the date and time of the alleged violation, including the time zone and (3) any available evidence of the alleged violation. When reporting an issue regarding unsolicited eMail please provide a copy of the eMail messages with full headers that typically provide all of the above data. Other situations will require different methods of providing the necessary information.

    B. Privacy

The Association Website located at http://www.ArmySignalOCS.com and those Sites operated by closely associated entities of the Association may collect information to improve functionality and content of the Site and to monitor Site performance. Data collected will be used to help answer specific questions about the usage and performance of the Website or individual Web pages. Generally speaking Site usage is not associated with individual IP addresses, except in the case where use of such information will contribute to a more enjoyable browsing experience. Such instances may include but not be limited to use of IP address information to assure security when filling out online forms, to recognize a Site visitor on subsequent visits, and other similar events.

Other Sites linked to the http://www.ArmySignalOCS.com site, such as 1) those of closely held entities to the Association or 2) third party sites which you may navigate to as a result of clicking on a link found on a Association Site, may have different privacy practices. You should review the Privacy Policy statement of each such site and consider your use of them accordingly.

It is the policy of the Association to disclose on its Websites what information is collected that can be used to personally identify the user and how that information is intended to be used (see for example the section below labeled "Miscellaneous Information"). Currently the Association does not collect personally identifiable information except in online forms which you may voluntarily fill out through your own actions. Generally, the information this Site collects is used for the above stated purpose of maximization of Site performance. Notwithstanding this, you should understand that if as a result of your use of the Association Site you either 1) fill in a form found on this or an associated site or 2) send an eMail to us as a result of your use of this or an associated site, then any information you provide in said form or eMail may be used by the Association as though it was freely given and not subject to confidentiality. For further clarification on this issue, please see the section below labeled “Miscellaneous Information”.

    C. Trademarks

Signal Corps OCS Association, Inc., Association, ArmySignalOCS, and all related trademarks are the property of the Association. These names and trademarks may not be used by third parties without the express prior written consent of the Association. Other trademarks, service marks and trade names used on Association Sites are the property of their respective owners.

    D. Illegal Copying

All content included on the Sites, including, but not limited to, text, graphics, logos, buttons, icons, images and software is the property of the Association, the Private Party, or its/their licensors or grantors and is protected by U.S. and international copyright and trademark laws. Reproduction, duplication, modification, distribution, transmission, replication, display or performance of the content of the Sites without the express advance written permission of the Association is strictly prohibited. If you have a concern regarding the use of copyrighted material on any Association Website, please contact the Association Webmaster at Webmaster@ArmySignalOCS.com. Said Webmaster is designated as an agent authorized to be responsible for responding to reports alleging copyright infringement. To be effective, the notification must be in writing and contain the following information (DMCA, 17 U.S.C. §512(c)(3)): (1) Physical or electronic signature of a person authorized to act on behalf of the copyright owner; (2) Identification of the copyrighted work claimed to have been infringed; (3) Identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled as well as information reasonably sufficient to permit the Association to locate the material; (4) Contact information of the complaining party; (5) A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agents, or the law; (6) A statement that the information in the notification is accurate and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. Upon receipt of such information the Association will act in a timely manner to investigate any such complaint and assure compliance with all such laws.

    E. Site Usage

The Website may provide links to third-party Web sites that are not under the Association's control. These links are provided for convenience only and unless otherwise expressly stated by the Association are not intended as an endorsement by the Association of the organization or individual operating those third-party Web sites, or a warranty of any type regarding the third-party company, third-party Web sites or the information on them. Links from a Website located on a the Association server to a third-party Web site or references to third-party brands, products or services do not imply the Association’s endorsement of those Web sites, products or services.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY: SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. THE ASSOCIATION DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR, AS APPLICABLE, FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE ASSOCIATION MAKES NO EXPRESS WARRANTIES AND YOU WAIVE ALL IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE REGARDING ANY MERCHANDISE, INFORMATION OR SERVICE PROVIDED THROUGH OR BY THE ASSOCIATION OR VIA THE SITES. YOU EXPRESSLY ACKNOWLEDGE THAT THERE ARE SECURITY, PRIVACY, AND CONFIDENTIALITY RISKS INHERENT IN INTERNET COMMUNICATIONS AND TECHNOLOGY AND THE ASSOCIATION DOES NOT MAKE ANY ASSURANCES OR WARRANTIES RELATING TO SUCH RISKS. NO ADVICE OR INFORMATION GIVEN BY THE ASSOCIATION OR ITS REPRESENTATIVES AND/OR VENDORS SHALL CREATE A WARRANTY.     F. Jurisdiction

This Agreement is governed by Georgia law without regard to conflict of law provisions. The federal and state courts located in the County of Rockdale, Georgia, alone have jurisdiction over all disputes arising out of or related to this Agreement and the services. You consent to the personal jurisdiction of such courts sitting in the County of Rockdale, Georgia, with respect to such matters or otherwise between you and the Association and waive your rights to removal or consent to removal.

    G. Miscellaneous Information

This Agreement is posted as a Website Privacy and Use Policy on the Sites. It constitutes the entire agreement between you and the Association with respect to your use of the Sites and the Services offered on and by the Sites. The Association may revise, amend, or modify this Agreement and any other user policies and agreements at any time and in any manner. All such revisions will be posted on the Sites. You should periodically review this Website Privacy and Use Policy posting for any additions, changes and amendments.

The Association has created this Website Privacy and Use Policy to demonstrate our firm commitment to protecting users’ personal information and informing you about how we handle it. This Website Privacy and Use Policy applies to transactions and activities on the  Association Web Sites accessible to the public without password and does not apply to any other Web site or offline point of contact between you and the Association, its employees or affiliates. Please review this privacy policy periodically as we may modify it from time to time. Please be aware that each time you visit the Site or provide us with information, by doing so, you are accepting the practices described in this privacy policy as of that date and time.

  • Regarding your IP address: Like most business Websites, each time you visit the Site we automatically collect your IP address and the Web page from which you came. In order to administer and optimize the Site for you and to diagnose problems with our Site we use your IP address to help identify you and to gather broad demographic information about you.

  • Cookies: Like most Websites, the Site uses cookies to keep track of your activity on the Site and enhance your experience on the Site. We also use cookies to deliver content specific to your interests.

  • Information We May Collect From You: In addition to your IP Address and cookies the only personal information we collect from you that could be used to identify you is your machine’s hostname (also known as machine name) and/or the domain name of the preceding site from which you came to visit the Site. We use your hostname and/or the domain name information to gather statistical information on our Site usage. We do not knowingly collect any information, personal or otherwise from children under the age of 16 without the express consent of their parent or guardian.

  • Information Other Web Sites Collect From You: On the Site we may place links to other Web sites operated by other parties. Some of these other Web sites contain our organization's name and trademarks and other intellectual property that we own; others do not. When you click on these links and visit these other Web sites, regardless of whether or not they contain our brand names, trademarks and other intellectual property, you need to be aware that we do not control these other Web sites or these other Web sites’ business practices and that this privacy policy does not apply to these other Web sites. Consequently, the operators of these other Web sites may collect different kinds of information about you and may use and disclose that information in different ways than we would if it were collected on the Site. We encourage you to review their privacy policies and remind you that we will not be and are not responsible for their actions.

  • How We Use Personal Information: We use your personal information to fulfill specific requests that you might make for information about the Association’s various programs, products, services, special events and, if you agree, to send to you by return eMail or postal mail other information relating to the Association. We carefully select the information we send to you and attempt to send you information of value to you. Such information may include news about the Association, special products, services, pricing, opportunities or special event information. If you fill in a form on our Site the Site will provide you with the option of declining to receive offers from the Association by “opting-out” of receiving this type of communication. If you chose to "opt-out" we will honor your choice and not send you any information. If instead of filling out a form you chose to send us an eMail that you originate yourself, this option will not be present, and accordingly any information you include in your eMail we will feel free to use unless you inform us otherwise.

  • How We Use Financial Information: On the limited occasion in which we collect any financial information from you, such as when you elect to purchase something from us through one of our Sites, we will only use your financial information to 1) fulfill orders you place on or through the Websites and/or 2) respond to your request for financing assistance re. the purchase of certain products or services. Any financial information we collect from you will be used internally by our finance department and will also be directly forwarded to our fulfillment service (e.g. a credit care processing company). Information is collected on secured sites operated by or on behalf of the Association for specific transactions and services.

  • How We Use Health Information: Generally speaking, the only information we have about you is information you provide us. We do not search for or attempt to find other information about you, health related or not, unless that information is required in order for us to fulfill an order or request you have placed with us. If you provide us with information in relation to the purchase or use of a product or service we provide, then we will use that information to the extent necessary to furnish the product or service. While the information you provide may have components of it that are health related, we will not consider it health information unless you specifically instruct us to do so and ask us to treat that specific information confidentially. If on the other hand, while in the course of trying to fulfill an order or request you placed with us, we receive information about you from a third party source, such as your doctor or medical provider, and it contains health related information, then we will protect and treat such information in accordance with all applicable laws (HIPAA, et al). Regardless of what type of information you provide us, unless you specifically instruct us otherwise, we will use it in accordance with the policies stated on this page.

  • Our Security Precautions, Location of Information: You should be aware that our Sites are hosted on servers provided by third party sources. While we take precautions to adhere to the Website Privacy and Use Policy stated herein, we have no control over others who may have access to or control the use of technology related to or used in support of our Sites. While our Sites have security measures in place to protect against the loss, misuse and alteration of information under our control, we can not assure you that others who set up and maintain the world wide web, including those who host our Sites on their servers, or otherwise support our Sites, have or follow such policies and measures. Your information may be transferred to and maintained on computer networks which may be located outside of the city, county, state, province, country or other governmental jurisdiction in which you and/or we reside, and while the regions in which these computer networks are located may or may not have privacy laws as protective as the laws in your area, the users of such systems may or may not adhere to those laws.

  • How You Can Access and Update Your eMail Preferences, Personal Information and Public/Private Designations: Customers who are given secure User Name and Password access to sections of our Site will be informed of how they may change their personal information. General customers and Site visitors who are not authorized to access these secure sections will find that this type of information is generally stored on their personal computer in the form of a cookie that was created when they visited a Website. The Association is not responsible for information collected on your computer on behalf of other sites where that information is saved in cookies.

  • Disputes: By using our Sites, you agree to be bound by our Terms of Use. You also agree that any unresolved disputes arising from your use of our Sites, services obtained from or purchases made from the Sites and/or any disputes arising from this Website Privacy and Use Policy shall be governed by Georgia law. You agree that the venue for resolving such disputes shall be in the County of Rockdale, Georgia.
